Overview
The Danish Ministry of Environment has issued a separate Order No.904 on Extended Producer Responsibility (EPR) for selected Single-Use Plastic Products (SUP). This Order is part of Denmark’s broader efforts to tackle environmental impact and promote sustainability. The Order aligns with Europe’s drive to minimise plastic waste and enhance recyclability.
Scope of Products
Denmark’s EPR order targets a range of single-use plastic products, including:
- Food containers,
- Packaging bags and foils,
- Beverage containers,
- Drinking cups,
- Lightweight plastic carrier bags,
- Wet wipes,
- Balloons, and
- Filters for tobacco products.
According to a report by the European Commission, these are the top single-use plastic items found as litter in nature e.g. on European beaches, significantly contributing to environmental pollution. Tariff income will be used to collect and transport the said waste fragments into the normal recycling loops and to inform the public on the importance of using established waste collection systems.
Who Needs to Comply?
This new regulation defines producers of single-use plastic as:
Domestic Producers
Anyone in Denmark who makes, fills, imports, or distributes the selected single-use plastic products in Denmark, no matter how they distribute them.
Foreign Producers
Anyone from another EU country or outside the EU who sells the selected single-use plastic products directly to people in Denmark through online or mail orders. Foreign producers can assign an Authorized Representative (AR).
Do you also need to consider adherence to other Danish EPR regulations? Yes—if your single-use plastic product is defined as packaging, you are likely also required to register and pay tariffs in the separate Danish EPR scheme for Packaging.
