The threshold is 8 tons per year. Companies above the threshold will have to report weight per category, companies below the threshold are required to report less detailed information.
Why packaging compliance?
Denmark’s new Packaging waste regulation will transpose the EU Packaging & Packaging Waste Directive by implementing the Packaging Extended Producer Responsibility (EPR). Extended Producer Responsibility (EPR) for packaging will come into effect in 2025. Obligated stakeholders will be legally obligated to implement new compliance processes for the Packaging that they place onto the Danish market.
Embracing EPR will result in:
- Reduce the amount of Packaging put to market,
- Raise reuse and recycling rates of Packaging,
- Encourage companies to re-think their Packaging and increase the amount of circular Packaging.
Who are the stakeholders?
- Producers that are established in Denmark and bring Packaging on the Danish market
* In this context, “producer” refers to the entity responsible for filling the packaging, rather than the one involved in manufacturing the packaging itself.
- Danish importers of packaged products that are the first in the distribution chain,
- Wholesalers or re-packaging companies,
- Foreign distance sellers that are directly selling to Danish end-consumers, Note: these sellers will need an Authorized Representative (AR)
- When exporting Packaging out of Denmark, the importer in the target country is taking over obligations and the obligations at the target country apply.
What is the scope?
The updated Extended Producer Responsibility (EPR) framework encompasses primary, secondary, tertiary, and service packaging. Producers must report their market volumes in weight, categorized by material type, and segmented into household or commercial packaging.
What actions are required as of now?
Register with the Danish Producer Responsibility System DPA starting from 1 April 2024 until 31st of August 2024,
Choose an Authorized Representative (AR) starting from 1 April 2024 til 31st of August 2024. (only necessary if you are a non-Danish EU producer),
Choose a packaging scheme starting from 1 April 2024 til 31st of August 2024. (this requirement applies to all producers),
Report Packaging forecasts of quantities put to market in 2024 from 1 April 2024 til 31st of August 2024. (materials, size, weight, chemical composition); subsequently, reporting is required annually.

FAQs
Registration is open from April 1, 2024, until August 31, 2024. Producers must register themselves and their representatives no later than August 31, 2024, or 14 days before making packaging available on the Danish market thereafter.
To register as a foreign company, you must create an account with the DPA. Without a MitID, you can register using a login name and password. Once approved by your chosen Authorized Representative (AR), they can assume your obligations with a Danish MitID. If you’re a Danish company, your chosen compliance scheme can take care of the registration for you.
Upon registration, you need to provide forecasts for the expected packaging you’ll put to market in 2024. AR will be able to assist you if you provide them with the forecast data.
Yes, there is a one-time registration fee. Newly registering companies pay DKK 1000, while producers with existing registrations pay a reduced fee of DKK 500. Please note that membership fees with your chosen compliance scheme apply as well.
The Order was published on March 21, 2024, and became effective on April 1, 2024.
The system becomes effective in 2025.
Foreign companies from an EU country that do not have an entity in Denmark and are engaging in remote sales directly to end-users in Denmark are obligated to appoint an Authorized Representative (AR) in Denmark. This AR will assume the foreign company’s producer responsibilities for products sold within the Danish market.
An AR must be a legally established entity in Denmark that has a Danish CVR number. It is selected by one or multiple foreign companies within the EU to assume their producer obligations in Denmark. RLG RENE can offer you this service.
If your company has assigned an AR, this representative can assume your interests related to Extended Producer Responsibility, such as selecting a suitable compliance scheme or choosing individual solutions. An AR can also take over specific tasks assigned by the DPA, such as signing a management statement or reporting declaration statement on your behalf.
