Single-Use Plastics and Denmark’s New EPR Regulations
Overview
The Danish Ministry of Environment has published Order No.904 on Extended Producer Responsibility (EPR) for Single-Use Plastics (SUP). This Order is part of Denmark’s broader efforts to tackle environmental impact and promote sustainability. The new ERP regulation will take effect on December 31, 2024. The Order aligns with Europe’s drive to minimise plastic waste and enhance recyclability.
Scope of Products
Denmark’s EPR order targets a range of single-use plastic products, including:
- Food containers,
- packaging bags and foils,
- beverage containers,
- drinking cups,
- lightweight plastic carrier bags,
- wet wipes,
- balloons, and
- filters for tobacco products.
According to a report by the European Commission, these are the top single-use plastic items found as litter on European beaches, significantly contributing to environmental pollution. The goal is to promote a shared responsibility among producers for the entire lifecycle of their products.
Who Needs to Comply?
This new regulation defines producers of single-use plastic as:
Domestic Producers: Anyone in Denmark who makes, fills, imports, or sells single-use plastic products in Denmark, no matter how they sell them.
Foreign Producers: Anyone from another EU country or outside the EU who sells single-use plastic products directly to people in Denmark through online or mail orders. Foreign producers can assign an Authorized Representative (AR).
