Maine Governor Janet Mills signed LD 1541 on Jul 13, 2021 into law, making Maine the first state in the U.S. to pass an extended producer responsibility (EPR) law for packaging. The law requires producers (most brand holders with a residence in the U.S. or first importers for brand holders with no physical presence in the U.S.) that sell products in or into Maine that are contained, protected, delivered, presented or distributed in or using packaging material to join and pay fees to an independent packaging stewardship organization. The stewardship organization will be chosen by the State via a competitive bidding process and manage funds paid by producers to reimburse participating municipal recycling programs and enhance the state’s existing recycling infrastructure, public education and consumer awareness.
